How we use your information

We write to people using information they did not give us, so we owe them a clear account of it. This notice explains what we hold, where it came from, why we use it and how to make us stop.

Who we are

Landkite Ltd is the controller of your personal information. Company number: 17486084. Registered office: 13 Portland Road, Birmingham, B16 9HN. Information Commissioner’s Office registration: to follow.

For anything about your information, call 07545 883304 or email hello@landkite.co.uk. Max Derry is responsible for how we handle it.

What we hold about landowners we write to

  • Your name, and the postal address shown for you on a public record
  • The land concerned: its location, boundaries and, where we have it, its title number
  • Where each piece of information came from, and when
  • The letters we sent you, and when

We only name someone as an owner when an authoritative record says so, such as HM Land Registry’s register. We do not use names from the electoral roll or planning applications to write to anyone.

When no record gives us an owner’s name, we may write instead to “The Owner” at a postal address that open address data places on the land itself. That letter names nobody, and we keep only the address and the land it is about. If you would rather we did not write to that address, our stop letters form takes an address and postcode alone.

What we hold if you contact us

  • What you send through our website forms: your name, email address or phone number, how you would like a reply, and what you tell us about yourself or your land
  • Your contact details, and those of anyone you ask us to deal with
  • What you tell us, and notes of our conversations
  • If you go ahead, the details needed to prepare and complete an agreement, including identity checks

Where it comes from

Apart from what you tell us, our information comes from public records: HM Land Registry (including its registers and ownership data), Ordnance Survey and HM Land Registry open data, local planning records, Companies House when land is owned by a company, and property data suppliers when we look up the postal address of a property on the land. Our letter says which record we used for you.

Why we use it, and our lawful basis

  • To write to you about your land. We rely on legitimate interests: finding land where new homes may be possible, and asking its owner whether they want to talk. We have weighed this against your interests. We write only about specific land, we tell you where your details came from, and we stop the moment you ask.
  • To talk to you and prepare a proposal, if you ask us to. We rely on legitimate interests, and on taking steps towards a contract at your request.
  • To keep a do-not-contact record, so that we never write to you again once you ask us to stop. We rely on legitimate interests and on our legal obligations.
  • To meet legal obligations, such as keeping records and carrying out identity checks before a property transaction.

We do not sell your information, and we do not use it to market anything other than an arrangement about your own land.

Software and automated tools

We use software, including artificial intelligence tools, to study maps and public records and to help draft letters. A person decides who we write to and reads every letter before it is sent. No decision with legal or similarly significant effects on you is made by software alone.

Who we share it with

  • Service providers who work for us under contract: the company that prints and posts our letters, our hosting, email and software providers, and suppliers of land and property data
  • If you decide to go ahead: planning, legal and building specialists, the investors who fund the work, and the company that would sign the agreement. We tell you who they are first
  • Anyone we are required to share it with by law, such as a court or regulator

Some providers may process information outside the UK. Where they do, we use the safeguards the law requires, such as the contract clauses set by UK law for international transfers.

How long we keep it

  • If we write to you and nothing comes of it, we review your record 24 months after our last contact and delete what we no longer need
  • If you ask us to stop, we keep only scrambled (hashed) records of the details that identify you, such as your name with your postcode, your address, your email address or your phone number, so that we can recognise you and never write again. They cannot be read back into your details
  • If you enter an agreement with us, we keep the records for as long as the agreement lasts and then for as long as the law requires, usually six years

Your rights

You have the right to:

  • Object to our use of your information, including being written to. We will stop
  • Ask for a copy of what we hold about you
  • Ask us to correct anything that is wrong
  • Ask us to delete your information, or to restrict how we use it
  • Ask for information you gave us in a form you can pass to someone else

Call or email us to use any of these rights. There is no charge, and we answer within one month. We may need to check who you are first.

Complaints

If you are unhappy with how we have handled your information, please tell us and we will try to put it right. You can also complain to the Information Commissioner’s Office at ico.org.uk or on 0303 123 1113.

This website

This website does not use cookies, analytics or advertising trackers, and stores nothing on your device. When you send a message or tell us about land, the website emails what you wrote to us and keeps no copy of its own. Our hosting provider, Cloudflare, and our email delivery provider, MailerSend, process it on the way. Cloudflare also processes technical information, such as your IP address, to deliver the site and protect it from attack, and keeps it only briefly.

If you arrive from our letter

The QR code on our letter carries the reference printed on it. When you open the website with that code, or type the reference into our contact form, the website tells our own records system that the reference was used, when, and which page you arrived on. If the link also carried campaign labels (such as which mailing it came from), those are included. We do this to know that our letter reached you, which helps us decide whether writing again makes sense, and we rely on legitimate interests.

Your IP address, browser and device details are not passed on. The website then removes the reference from the address bar, so one visit is counted once. We keep the record with the letter it belongs to, and delete it when we delete your record. Campaign labels on a link with no letter reference are not recorded.

If you use our stop letters form

The website sends what you type (the reference on our letter, or your address and postcode, and any name, email address or phone number you add) to our records system, which adds you to our do-not-contact list straight away. We keep those details only as a scrambled (hashed) record, so that we can recognise you and never write again. The website keeps no copy.

The website also sends your IP address, used only to limit repeated requests from one person. Our records system keeps it as a one-way hash in its log of requests, never as the address itself.
